1. Acceptance of Terms

These Terms & Conditions (“Terms”) constitute a legally binding agreement between you (“User”, “Customer”, “you”) and Fortune Optical – Cracia Lens Division (“Cracia”, “we”, “us”, “our”), governing your access to and use of www.cracia.in and any related mobile or web application (collectively, the “Platform”), including browsing, registration, and the purchase of prescription and non-prescription eyewear lenses and related products (“Products”). By accessing the Platform or placing an order, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

2. Eligibility

You must be at least 18 years of age and capable of entering into a legally binding contract under the Indian Contract Act, 1872 to use the Platform and place an order. If you are under 18, you may use the Platform only with the involvement and consent of a parent or legal guardian.

3. Account Registration

• You agree to provide accurate, current, and complete information during registration and to update such information as necessary.
• You are responsible for maintaining the confidentiality of your account credentials and for all activities conducted through your account.
• You must notify us immediately of any unauthorised use of your account.

4. Products and Prescription Accuracy

Cracia manufactures made-to-order prescription lenses based on the details submitted by you at the time of purchase.

• You are solely responsible for ensuring that the prescription details (SPH, CYL, Axis, ADD, PD) entered at checkout are accurate and current, based on a valid prescription issued by a qualified optometrist or ophthalmologist.
• ${brand} manufactures lenses strictly in accordance with the values submitted and does not independently verify the medical accuracy of a prescription.
• We recommend obtaining an eye examination within the preceding 12 months before placing an order for prescription lenses.
• Product images are for representation purposes only; actual lens appearance, including coatings and tints, may vary slightly.

5. Pricing and Payment

• All prices displayed on the Platform are in Indian Rupees (INR) and are inclusive of applicable Goods and Services Tax (GST), unless stated otherwise.
• Prices may vary based on lens power, lens index, coatings, and add-on features selected.
• We reserve the right to modify pricing at any time without prior notice; however, orders already confirmed will not be affected by subsequent price changes.
• Payments are processed through secure, PCI-DSS compliant third-party payment gateways. We do not store your complete payment card details.
• In the event of a failed transaction where the amount has been debited, the amount will be automatically reversed by the payment gateway or bank within the standard reversal timeline of that provider.

6. Order Confirmation and Processing

An order is confirmed only upon successful payment and receipt of an order confirmation via email or SMS. As Products are custom-manufactured to your prescription, order processing begins promptly after confirmation, and modification or cancellation windows are limited as described in our Shipping Policy and Return & Refund Policy.

7. Intellectual Property

All content on the Platform, including but not limited to the Cracia name, logo, trademarks, product designs, graphics, text, images, and software, is the exclusive property of Fortune Optical – Cracia Lens Division or its licensors and is protected under applicable Indian and international intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any part of the Platform without our prior written consent.

8. User Conduct

You agree not to:

• Use the Platform for any unlawful purpose or in violation of these Terms.
• Submit false, inaccurate, or fraudulent prescription or payment information.
• Attempt to gain unauthorised access to the Platform, its servers, or any connected network.
• Interfere with or disrupt the security or integrity of the Platform.
• Copy, scrape, or reproduce Platform content for commercial purposes without authorisation.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Fortune Optical – Cracia Lens Division shall not be liable for any indirect, incidental, special, or consequential damages arising out of or related to your use of the Platform or Products, including but not limited to loss of vision, discomfort, or injury arising from an inaccurate prescription submitted by you. Our aggregate liability in respect of any claim relating to a Product shall not exceed the amount paid by you for that Product.

Nothing in these Terms shall limit or exclude liability that cannot be limited or excluded under applicable Indian law, including the Consumer Protection Act, 2019.

10. Warranty and Product Quality

Products are manufactured using quality-controlled processes and, where stated, conform to relevant ISO and ANSI optical standards. Any manufacturing defect must be reported within the timeframe specified in our Return & Refund Policy for the applicable remedy to apply.

11. Third-Party Services

The Platform integrates third-party services for payment processing, logistics, and communication (including but not limited to payment gateways and courier partners). Your use of such third-party services may be subject to their respective terms and policies, over which we have no control and for which we accept no liability.

12. Suspension and Termination

We reserve the right to suspend or terminate your account and access to the Platform, without prior notice, if we reasonably believe you have violated these Terms, engaged in fraudulent activity, or misused the Platform.

13. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts at Ghaziabad, Uttar Pradesh, India.

14. Amendments to These Terms

We may revise these Terms from time to time. The revised Terms will be effective as soon as they are published on the Platform, indicated by an updated “Effective Date”. Your continued use of the Platform following such changes constitutes your acceptance of the revised Terms.
